A seminar in the Special Branch, the role of the judicial mortgage in guaranteeing the right of creditors
The Special Branch of the College of the Law / University of Karbala conducted a seminar to discuss the master’s thesis project submitted by a graduate student (Sari Abbas Thamer) and tagged (The Role of Judicial Mortgage in Securing the Right of Creditors – A Comparative Study). The seminar showed that the Iraqi civil law did not address the legal role of mortgage Judicial as one of the executives means on the debtor’s money, similar to the Algerian and French legislation, despite its importance in providing solid support for the creditor as a guarantor of his debt, as he is the holder of an enforceable bond before the debtor against whom the mortgage is requested.
The Scientific Committee in the private law discussed the research project and expressed its directives to the student. It also made some substantive modifications in the scientific research methodology and others in the research plan and the origin of the research topic. It also discussed the fundamental issue in the research. The committee recommended that the topic should be divided into investigations in a coherent manner and put the topics within investigations assigned to it.
